These Terms and Conditions govern your access to the Family Fun Powersports LLC website and your purchase or use of our golf carts, parts, accessories, services, and related products.

By accessing our website, submitting an order, or purchasing a product or service from us, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

References to “Family Fun Powersports,” “we,” “us,” or “our” mean Family Fun Powersports LLC. References to “customer,” “you,” or “your” mean the person or organization using our website or purchasing from us.

2. Acceptance of Terms

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order.

If you make a purchase on behalf of a business or another organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree with these Terms, do not use our website or submit an order.

A vehicle purchase may also be governed by a buyer’s order, invoice, financing agreement, manufacturer warranty, or other transaction-specific document.

If a signed transaction document conflicts with these general Terms, the signed document will control for that transaction, except where prohibited by law.

4. Product Information

We make reasonable efforts to provide accurate product descriptions, specifications, prices, availability information, and images.

Colors and appearance may vary because of lighting, photography, display settings, vehicle condition, manufacturer changes, or differences between individual units.

Vehicle range, speed, charging time, capacity, and performance may vary based on factors including:

  • Make, model, age, and configuration

  • Battery type, age, condition, and charge level

  • Passenger and cargo weight

  • Terrain, temperature, weather, and driving habits

  • Tires, accessories, modifications, and maintenance history

Product descriptions and performance estimates are informational and are not guarantees unless expressly included in a signed sales agreement or written warranty.

5. New and Pre-Owned Products

The condition and included features of each new or pre-owned product will be identified in its listing, invoice, or sales agreement.

Pre-owned products may display normal wear consistent with their age, mileage, hours, maintenance history, and previous use. Known material conditions will be disclosed as required by applicable law.

Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.

6. Prices, Taxes, and Fees

Prices are listed in U.S. dollars unless otherwise stated.

Applicable taxes, shipping charges, registration fees, title fees, optional accessories, financing charges, and other transaction-specific costs may be added where permitted. Applicable charges will be disclosed before the purchase is finalized or in the governing sales documents.

We may change prices before accepting an order. A price change will not affect an order already accepted unless the customer agrees or correction is otherwise permitted by law.

If a listing contains a clear pricing or typographical error, we may correct the error or cancel the affected order. If payment has already been collected for a canceled order, the applicable amount will be refunded.

7. Orders and Acceptance

Submitting an order constitutes an offer to purchase. An automated acknowledgment or payment authorization does not necessarily mean that the order has been accepted.

We may verify product availability, payment information, shipping details, and suspected fraud before accepting an order.

We reserve the right to decline or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Incorrect pricing or product information

  • Payment failure or suspected fraud

  • Shipping restrictions

  • Legal or regulatory restrictions

  • An inability to complete the transaction safely or lawfully

If we cancel an order after collecting payment, we will issue the appropriate refund according to applicable law.

8. Payment

You agree to provide current, complete, and accurate billing and payment information.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to process the applicable charges.

Financing arrangements may be governed by separate terms provided by the lender or financing provider. Family Fun Powersports LLC is not responsible for the acts or decisions of an independent lender.

9. Order Cancellation

Subject to our published Cancellation Policy, customers may request cancellation and a full refund within 12 hours of placing an order.

After the cancellation window, an order may have entered processing, preparation, or shipping arrangements and may no longer be eligible for cancellation.

Orders that have shipped or been assigned to a carrier cannot ordinarily be canceled. Address corrections may be possible before shipment but are not guaranteed.

Cancellation requests should include the customer’s name and order number and must be submitted through our phone number, email address, or contact page.

10. Shipping and Delivery

Shipping methods, processing estimates, transit estimates, costs, tracking procedures, and delivery support are governed by our Shipping and Delivery Policy.

Delivery dates are estimates unless expressly guaranteed in writing. Weather, carrier delays, product availability, holidays, incorrect address information, and other circumstances may affect delivery.

If we cannot ship within the promised time, we will provide any notice, cancellation option, or refund required by applicable law.

Customers must provide an accurate and accessible delivery address. Additional costs caused by incorrect information, restricted access, failed delivery attempts, or customer-requested changes may be charged where permitted and disclosed.

11. Freight Delivery and Inspection

Large products may be delivered using qualified freight or vehicle-transportation providers.

Customers should inspect delivered products as soon as reasonably possible. Visible shipping damage should be noted on the carrier’s delivery documentation and reported promptly to both the carrier and Family Fun Powersports LLC.

Customers should retain the product, packaging, photographs, delivery documents, and other relevant evidence while a damage claim is being reviewed.

These inspection procedures do not waive any rights that cannot legally be waived.

12. Returns and Refunds

Return eligibility, deadlines, product-condition requirements, restocking charges, return-shipping responsibilities, and refund procedures are governed by our published Returns and Refund Policy.

No return or refund is guaranteed unless it qualifies under that policy, a written sales agreement, or applicable law.

Approved refunds will generally be issued to the original payment method unless another method is required or agreed upon.

13. Limited Warranty

Eligible products may be covered by a manufacturer’s warranty, a Family Fun Powersports LLC Limited Warranty, or both.

Warranty duration and coverage vary by product and manufacturer. Customers should review the applicable warranty before purchasing.

A written warranty does not exclude or restrict any implied warranty or consumer protection that cannot lawfully be excluded or restricted.

Warranty coverage will not be denied solely because a customer used third-party parts or services when such a restriction is prohibited by law. However, damage caused by improper repairs, incompatible parts, misuse, neglect, or unauthorized modifications may be excluded when permitted by the applicable warranty and law.

14. Vehicle Operation and Legal Compliance

Customers are responsible for determining whether a golf cart is lawful and suitable for its intended location and use.

Depending on the jurisdiction and vehicle configuration, legal requirements may include:

  • Registration and titling

  • Driver licensing

  • Insurance

  • Required lighting and safety equipment

  • Seat-belt or helmet use

  • Speed restrictions

  • Age restrictions

  • Road-use permissions

  • Commercial-use permits

A vehicle’s availability for purchase does not mean it is approved for operation on every public road or in every jurisdiction.

15. Safety and Modifications

Customers must operate and maintain products according to manufacturer instructions and applicable laws.

We do not condone reckless operation, overloading, operation while impaired, use in prohibited areas, or removal of required safety equipment.

Modifications may affect safety, performance, warranty coverage, insurance requirements, and legal classification. Customers assume responsibility for confirming the legality and suitability of requested or post-purchase modifications.

Family Fun Powersports LLC is not responsible for damage caused by unsafe use or improper modifications, except where liability cannot lawfully be excluded.

16. Website Use

You may use our website only for lawful personal or business purposes related to evaluating or purchasing our products and services.

You may not:

  • Use the website for fraudulent or unlawful activity.

  • Attempt to gain unauthorized access to our website, accounts, or systems.

  • Introduce malware, harmful code, or disruptive technology.

  • Scrape, copy, or extract website content through unauthorized automated means.

Where a limitation is permitted, our aggregate liability relating to a product or transaction will not exceed the amount the customer paid for the product or service giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, personal injury caused by legally actionable conduct, breach of a non-waivable duty, or any other liability that cannot lawfully be excluded or limited.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold Family Fun Powersports LLC harmless from third-party claims, losses, or expenses arising from your unlawful use of our website, violation of these Terms, or unsafe or unlawful operation or modification of a product.

This provision does not require a consumer to indemnify us for our own negligence, unlawful conduct, or violation of a non-waivable legal duty.

We will not be responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, natural disasters, carrier interruptions, labor disputes, supply shortages, government action, public emergencies, or utility and network outages.

This section does not excuse any refund, notice, or other obligation that applicable law requires.

24. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer laws apply.

Before filing a claim, customers are encouraged to contact us so we can attempt to resolve the matter informally. This request does not prevent a customer from exercising a legal right or meeting a required filing deadline.

Any legal action may be brought in a court of competent jurisdiction in New Jersey, unless applicable law gives the customer the right to proceed elsewhere.

25. Changes to These Terms

We may update these Terms to reflect changes in our products, practices, website, or legal obligations.

Updated Terms will be posted with a revised effective date. Changes apply prospectively and will not materially alter an already accepted purchase unless agreed upon or permitted by law.

Continued website use after an update constitutes acceptance of the revised Terms for future use.

26. Severability and Waiver

If any provision is found unlawful or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

27. Entire Agreement

These Terms, the incorporated policies, and any applicable signed transaction documents constitute the agreement between the customer and Family Fun Powersports LLC concerning the relevant website use or transaction.

Any amendment to a completed sales agreement must be made in writing and accepted by the parties.
